Terms and Conditions

Rules

  1. All entrants must be students currently studying full-time programmes at universities or tertiary institutions in Hong Kong.
  2. All participating teams are strongly recommended to attend all related activities of the competition at specified dates, time and venues from 30 January 2021 to 30 May 2021, in order to receive the relevant information and trainings for the competition.
  3. Each shortlisted team will be entitled to a maximum of HK$2,000 subsidy for production. Valid documents of expenses including receipts or records are required to be produced and listed in the final report for claiming the relevant amount of subsidy. Shortlisted teams should work within the subsidy limit to complete the competition. Input of extra money is not allowed.
  4. The competition is administered solely by the Competition Commission and the Junior Achievement Hong Kong (“Co-organisers”). The Co-organisers reserve the final right of adjudication.
  5. Details of the competition will be announced at the workshop. Submission time of an entry is based on the time of receipt by the Co-organisers. Late submissions will not be accepted. The Co-organisers are not liable in any way for any loss, delay or transmission error during the submission of entries. If any participating teams cannot accomplish all required tasks of the competition and submit reports before the deadline, they will be deemed as withdrawing from the competition and their entries will not be considered.
  6. The Co-organisers own the administration rights to the pages or accounts set up by the participating teams on YouTube, Facebook, Instagram and other social media platforms for this competition.
  7. Participating teams should target Hong Kong residents as their audience in their entries.
  8. If a participating team receives any public enquiry or complaint related to the Competition Ordinance or the Competition Commission (“Commission”) on its social media channels or platforms, they should refer it to the Commission for follow-up.
  9. All participating teams, without prior consents from or arrangement by the Co-organisers, are prohibited from accepting financial sponsorships or other gifts, from any other organization or a third party during the competition. Participating teams will be disqualified and/or ineligible for prizes if they accept other financial sponsorships or gifts without prior consents from the Co-organisers.
  10. All participating teams must obtain prior consents from the Co-organisers before disseminating any information and messages related to the Competition Commission and the Competition Ordinance (including but not limited to, texts, photos, videos, interactive games and any content published in any format). The use and distribution of any materials bearing the Commission's logo is also subject to prior consents from the Commission.
  11. The decision by the judging panel will be final and binding. In the event that the judges are unable to find entries of sufficient merit, the Co-organisers may reserve their right not to allocate any award including the winner, the 1st and the 2nd runner-up.
  12. All shortlisted and winning teams must attend the award ceremony. Prizes and certificates will be awarded at the ceremony. Award recipients will also be invited to present their entries at the ceremony, if necessary.

Terms and Conditions

  1. By entering the Competition, participating teams acknowledge that they have read and understood the following terms and conditions (the Terms) and agree to be bound by them. The Co-organisers reserve the right to disqualify any team who has breached any of the Terms or to revoke the prize(s).
  2. Participating teams warrant to the Co-organisers that all data provided are true and accurate.
  3. In the event that a participating team comprises of less than 2 members at any time during the competition, the team will be disqualified. The Co-organisers reserve the right to determine the eligibility of such entrants, in its sole and absolute discretion, if there are substantial grounds.
  4. Participating teams acknowledge the sole responsibility for their entries; and the entries only reflect their personal views.
  5. No entry shall contain any content that is obscene, indecent, violent or defamatory. The Co-organisers reserve the right to require the participating team to amend or remove any entry with such content.
  6. All entries must be original works of the participating teams and have not been publicly released (including but not limited to texts, photos, videos, interactive games and other content published on social media platforms during the competition period). Participating teams should warrant that their entries do not infringe any intellectual property rights. If any actions of plagiarism, intellectual property rights infringement or unauthorised use are involved, the team(s) shall assume all liability arising from these actions and will be disqualified or become ineligible for the prizes. This term applies to all liabilities, losses, complaints, claims, compensation, expenses or the like whatsoever of any third parties which the Co-organisers may be subject to as a result of such infringement.
  7. If the use of an entry or any part of an entry (including but not limited to display and dissemination of the aforementioned entry) by the Co-organisers leads to infringement of an intellectual property right of any person that results in any allegation and/or claim, and as a result of which, the Co-organisers face any proceedings or claims, or are liable for any costs, damages, compensation, expenses or the like, the participating team shall indemnify the Co-organisers accordingly.
  8. If the Co-organisers find that or have reasonable grounds to suspect that a participating team has committed any fraudulent act, the Co-organisers reserve the right to disqualify the team or revoke any prize(s). If such act causes the Co-organisers any losses, or to be subject to any complaints or claims, or make the Co-organisers liable for any costs, compensation or expenses, the participating team(s) shall assume all such liability and indemnify the Co-organisers accordingly. This term applies to any liability, losses, complaints, claims, compensation or expenses or the like whatsoever of a third party which the Co-organisers may be subject to as a result of such act.
  9. If a participating team fails to complete the tasks and submit their report within the specified time frame, the Co-organisers reserve the right to determine the eligibility of the team.
  10. The Co-organisers shall incur no liability for any delays/losses/errors/garbled or damaged data during the delivery, registration or transmission of participating teams’ entries, information or files, or during the dissemination of the Co-organisers’ message due to reasons not attributable to or beyond the control of the Co-organisers or due to any other reasons, including but not limited to problems in connection with computers, networks, telephones or information technology, and the participating teams shall raise no objection.
  11. All entries submitted will not be returned.
  12. The Co-organisers reserve the right to use, including but not limited to edit, delete, copy, archive, transmit, publish and display, all the entries and their creative concepts for educational and promotional purposes. Participating teams agree to give the right to the Co-organisers to use, broadcast and edit their entries.
  13. Under the circumstances that no right of a third party is affected, the ownership of all entries (and any part of them) and related intellectual property rights (including but not limited to copyrights) will be vested in the Commission. Without prior written permission by the Commission, participating teams shall not offer their work for download by public or use them for any other purposes (except for participating in this competition).
  14. For the sake of fairness, staff of the Co-organisers and their family members are not allowed to participate in this competition.
  15. Regardless of whether prior notices or reasons have been provided, the Co-organisers reserve the right to make the following arrangement under any circumstances without notice: to modify, cancel or supplement the Terms and Conditions; to give out prizes of equivalent value.
  16. The personal data of all participating teams will be used only for the purpose of this competition. The participating teams/entrants understand and consent that the Co-organisers and their authorised persons could use, disclose or transmit the personal data for the aforementioned and all directly related purposes, or as permitted by the laws of Hong Kong. The Co-organisers will not disclose the personal data of the participating teams/ entrants to a third party and will keep the data confidential. After the competition, the Co-organisers will destroy all personal data collected for the competition. Unless the participating teams/ entrants expressly agree, the Co-organisers will not keep the personal data of participating teams/ entrants for promotion of future events. The participating teams/ entrants may check or make changes to their personal data already submitted to the Co-organisers by sending email to ptc.ja@jahk.org. For the collection of any personal data by the participating teams/ entrants through their related social media pages, participating teams/ entrants must abide by all related personal data privacy laws and regulations, including but not limited to the Personal Data (Privacy) Ordinance (Cap.486).
  17. Participating teams understand and consent to the Commission’s ownership of photos, videos and/or audio recordings taken during the competition events or award ceremony and their personal data for publicity purpose in future.
  18. The Co-organisers reserve the right of final decision on any disputes related to the competition.
  19. The Commission’s logo is owned by the Commission. Use of the logo by the participating teams is restricted to the competition only. Subject to prior consent of the Commission, the teams could disseminate or reproduce this logo for non-profit purposes only. Any other reproduction, adaptation, distribution, dissemination or offer of the logo for other purposes is strictly prohibited unless prior approval is obtained from the Commission.
  20. The Terms and Conditions shall be construed and interpreted in accordance with the laws of Hong Kong.
