Terms and Conditions

  1. The "Post to Compete" Social Media Advocacy Challenge 2024 (“Contest”) is administered solely by the Competition Commission (“Commission”) and the Junior Achievement Hong Kong (“JA HK”) (collectively “Co-organisers”). The Co-organisers reserve the final right of adjudication.
  2. By entering the Contest, participating teams acknowledge that they have read and understood the following terms and conditions (the “Terms”) and agree to be bound by them. The Co-organisers reserve the right to disqualify any team that has breached any of the Terms or to revoke the prize(s).
  3. Participating teams warrant to the Co-organisers that all data provided is true and accurate.
  4. In the event that a participating team has fewer than 2 members at any time during the Contest, the team will be disqualified. The Co-organisers reserve the right to determine the eligibility of such entrants, at their sole and absolute discretion, if there are substantial grounds.
  5. Participating teams are prohibited from accepting financial sponsorships or other gifts from any other organisation or third party during the Contest without prior consent from or arrangement by the Co-organisers. Participating teams will be disqualified and/or ineligible for prizes if they accept other financial sponsorships or gifts without prior consent from the Co-organisers.
  6. Participating teams must obtain prior consent from the Co-organisers before disseminating any information and messages related to the Competition Commission and the Competition Ordinance. This includes, but is not limited to, texts, photos, videos, interactive games, and any content published in any format. The use and distribution of any materials bearing the Commission’s logo is also subject to prior consent from the Commission.
  7. Participating teams acknowledge sole responsibility for their entries; and the entries only reflect their personal views.
  8. Entries must not contain any content that is obscene, indecent, violent or defamatory. The Co-organisers reserve the right to require the participating team to amend or remove any entry containing such content.
  9. All entries, including but not limited to texts, photos, videos, interactive games and other contents published on social media platforms during the Contest period, must be original works of the participating teams and must not have not been publicly released. Participating teams should warrant that their entries do not infringe any intellectual property rights. If any actions of plagiarism, intellectual property rights infringement or unauthorised use are involved, the team(s) shall assume all liability arising from these actions and will be disqualified or become ineligible for the prizes. This term applies to all liabilities, losses, complaints, claims, compensation, expenses or similar matters of any third parties to which the Co-organisers may be subject as a result of such infringement.
  10. If the use of an entry or any part of an entry (including but not limited to display and dissemination of the aforementioned entry) by the Co-organisers leads to infringement of any person's intellectual property rights, resulting in allegations, claims, proceedings, costs, damages, compensation, expenses, or similar consequences for the Co-organisers, the participating team shall indemnify the Co-organisers.
  11. If the Co-organisers find or have reasonable grounds to suspect that a participating team has committed any fraudulent act, they reserve the right to disqualify the team or revoke any prize(s). If such act causes the Co-organisers any losses, leads to complaints or claims, or makes the Co-organisers liable for any costs, compensation or expenses, the participating team(s) shall assume all such liability and indemnify the Co-organisers accordingly. This term applies to any liability, losses, complaints, claims, compensation or expenses or similar matters that a third party may hold the Co-organisers accountable for as a result of such actions.
  12. The Co-organisers shall not be liable for any delays, losses, errors, or garbled/damaged data during the delivery, registration or transmission of participating teams’ entries, information or files, or during the dissemination of the Co-organisers’ message due to issues beyond the control of the Co-organisers, such as problems with computers, networks, telephones, or information technology. Participants are expected not to raise objections in such cases.
  13. If a shortlisted team fails to complete the tasks and submit its report within the specified time frame, the Co-organisers reserve the right to determine the team’s eligibility.
  14. All entries submitted will not be returned.
  15. The Co-organisers reserve the right to use, including but not limited to edit, delete, copy, archive, transmit, publish and display, all entries and their creative concepts for educational and promotional purposes. Participating teams agree to grant the Co-organisers the right to use, broadcast, and edit their entries.
  16. Subject to no infringement of any third party rights, the Commission shall own all entries (in whole or in part) and related intellectual property rights, including but not limited to copyrights. Participating teams are not permitted to offer their work for public download or use it for any purposes other than participating in this Contest without prior written permission from the Commission.
  17. For the sake of fairness, staff of the Co-organisers and their family members are not allowed to participate in this Contest.
  18. The Co-organisers reserve the right to make the following arrangements under any circumstances, without prior notice or reasons: to modify, cancel, or supplement the Terms and Conditions; to award prizes of equivalent value.
  19. The personal data of participating teams will be used solely for the purpose of this Contest. Participating teams/entrants understand and consent that the Co-organisers and their authorised persons using, disclosing or transmitting the personal data for the aforementioned and any directly related purposes, or as permitted by the laws of Hong Kong. The Co-organisers will not disclose the personal data of the participating teams/entrants to a third party and will keep the data confidential. After the Contest, the Co-organisers will destroy all personal data collected for the Contest. Unless the participating teams/entrants expressly agree, the Co-organisers will not keep the personal data of participating teams/entrants for the promotion of future events. The participating teams/entrants may check or make changes to their personal data already submitted to the Co-organisers by sending an email to ptc.ja@jahk.org. When collecting any personal data through their related social media pages, participating teams/entrants must comply with all relevant personal data privacy laws and regulations, including but not limited to the Personal Data (Privacy) Ordinance (Cap. 486).
  20. Participating teams acknowledge and agree to the Commission’s ownership of photos, videos and/or audio recordings taken during the Contest events or awards ceremony, as well as their personal data for publicity purposes in future.
  21. The Co-organisers reserve the right to make the final decision on any disputes related to the Contest.
  22. The Commission owns the Commission's logo. Participating teams are only permitted to use the logo for the Contest. With the prior consent of the Commission, participating teams may disseminate or reproduce the logo for non-profit purposes only. Any other reproduction, adaptation, distribution, dissemination, or use of the logo for alternative purposes is strictly prohibited without prior approval from the Commission.
  23. The Terms and Conditions shall be construed and interpreted in accordance with the laws of Hong Kong.
